About these terms
These Terms & Conditions apply to the Positive Thinking Therapy website, enquiries, consultations, bookings and services. By using the website or booking a service, you agree to these terms.
Nothing in these terms excludes, restricts or modifies any right or consumer guarantee that cannot lawfully be excluded under the Australian Consumer Law or other applicable legislation.
About Positive Thinking Therapy
Positive Thinking Therapy provides individual clinical hypnotherapy and psychotherapeutic support from Melbourne, Victoria. Brad holds a Diploma in Clinical Hypnosis with Psychotherapy from The Essex Institute of Clinical Hypnosis and Hypnotherapy.
Clinical hypnotherapy is a general health service and is not a substitute for diagnosis, treatment or care from a registered medical practitioner, psychologist, psychiatrist or other appropriately qualified healthcare professional.
Website information
Website content is provided for general information and education. It is not personal medical, psychological, psychiatric, legal or emergency advice and should not be relied upon as a diagnosis or individual treatment plan.
Although reasonable care is taken when preparing content, Positive Thinking Therapy does not promise that every page will always be complete, current or appropriate to your circumstances. Contact an appropriately qualified professional for advice about your individual health needs.
Suitability and consultation
A booking does not guarantee that hypnotherapy will be suitable. Suitability may be discussed during the free consultation and reviewed throughout the therapeutic relationship.
Positive Thinking Therapy may decline, pause or discontinue a service where it is outside the practitioner’s competence or scope, presents a safety concern, requires another form of care, or is otherwise not appropriate. Where appropriate, you may be encouraged to contact your doctor, psychologist, psychiatrist or another suitably qualified professional.
Your participation
You agree to:
- provide information that is accurate and relevant to the safe provision of the service;
- advise Brad about significant changes to your circumstances, health or treatment that may affect a session;
- attend sessions free from the effects of alcohol or non-prescribed substances;
- participate voluntarily and ask questions if anything is unclear;
- join online appointments from a private, safe location where you will not be driving, operating machinery or responsible for an activity requiring continuous attention; and
- seek emergency or specialist assistance when your needs are outside the service offered by Positive Thinking Therapy.
You remain free to accept or reject suggestions during hypnosis and may ask to pause or end an exercise or session.
Clients under 18
A client under 18 may only receive a service when an adult is present. Consent from a parent or legal guardian must also be obtained before the service begins. Positive Thinking Therapy may decline or postpone a booking if suitable consent, adult attendance or an appropriate therapeutic setting cannot be confirmed.
Appointments and online sessions
Appointment times are displayed in the timezone stated in the booking system. You are responsible for checking the correct date, time and timezone.
Online sessions may depend on your internet connection, device, audio, camera and a suitably private environment. If a technical problem interrupts a session, both parties will make reasonable efforts to reconnect or agree on an appropriate next step.
Fees and payment
The applicable fee and payment arrangements will be disclosed before a paid service is confirmed. You agree to pay the amount communicated for the booked service, subject to your rights under the Australian Consumer Law.
The free 20-minute consultation is an introductory conversation and not a full therapy session.
Cancellation and rescheduling
You may cancel without charge by giving at least 24 hours’ notice before the scheduled appointment.
If you cancel within 24 hours of the scheduled appointment, a fee equal to 50% of the booked session price will apply, except where Positive Thinking Therapy agrees to waive it because of an emergency, serious illness or another exceptional circumstance.
Full details appear in the Cancellation & Rescheduling Policy. Nothing in that policy limits rights that cannot lawfully be excluded.
Outcomes and personal responsibility
Responses to hypnosis and psychotherapy vary. Positive Thinking Therapy does not guarantee a particular result, timeframe or permanent change. Progress may be influenced by the nature of the concern, suitability of the approach, attendance, participation, personal circumstances and other forms of care or support.
You remain responsible for your decisions, actions, medical care and use of information discussed during a session.
Emergencies and crisis support
Positive Thinking Therapy is not an emergency or crisis service and does not provide continuous monitoring or after-hours crisis care.
If you or another person is in immediate danger, call 000. If you are in Australia and need immediate crisis support, contact Lifeline on 13 11 14 or another appropriate crisis service. Do not use a website form, booking form or ordinary email for an emergency.
Intellectual property
Unless otherwise stated, the website’s original written content, branding, graphics, downloadable materials and session resources belong to Positive Thinking Therapy or are used with permission. They are provided for personal, non-commercial use.
You must not reproduce, sell, publish, modify or commercially exploit these materials without prior written permission, except as permitted by law.
External links and services
Links to third-party resources are supplied for convenience and do not necessarily constitute endorsement. Third-party platforms, including video, calendar, payment or email providers, operate under their own terms and privacy practices.
Limitation of liability
To the extent permitted by law, Positive Thinking Therapy is not responsible for indirect or consequential loss arising solely from reliance on general website information, interruptions outside its reasonable control or third-party websites and platforms.
This limitation does not exclude liability or remedies that cannot lawfully be excluded, including applicable Australian Consumer Law guarantees that services will be supplied with due care and skill.
Privacy
Personal and health information is handled as described in the Privacy Policy.
Changes to these terms
These terms may be updated when services, technology or legal requirements change. The terms applying to a booking will be those made available when the booking is confirmed, except where a change is required by law.
Governing law
These terms are governed by the laws of Victoria, Australia. The parties submit to the courts and tribunals with jurisdiction in Victoria, subject to any legal right to bring a matter elsewhere.
